Fair Use Policy

Acceptable Use

  1. This policy is designed to protect the quality and integrity of the Intellifone network and in doing so ensure all customers receive fair and equitable access. The policy specifically relates to usage of flat rate calls and free calls.
  2. We may depend on our Fair Use Policy in circumstances where your usage of "flat rate" or "free" untimed call charges that form part of a pricing plan or promotional offer is deemed to be excessive or unreasonable.
  3. We retain the right to vary the terms of the Fair Use policy at our discretion from time to time.

Excessive use

  1. Intellifone considers excessive use to be a call duration of more than 180 minutes per call where a "flat rate" applies, or four times the duration of our average user (which ever the greater) and a regularity of calling that indicates that the service is not being used for residential use only.
  2. If your use of the plan is excessive or unreasonable we will contact you by phone or email, using the contact details you have provided to us. If after our request your usage continues at a similar level we may change you to a more suitable Residential or Business plan, then charge you at the rates for that plan and backdated to when we made contact.

Unreasonable Use

Intellifone will supply the service for the purpose of you making and receiving calls on Our network for your personal use. Disconnection of your service may occur in the following circumstances.
  1. If we determine that you have used our Service or the provided device for an unlawful or inappropriate purpose or if We determine that the use or content does not conform to the requirements in this Agreement or that it interferes with our ability to provide service to You or others.
  2. If we determine that your use of the service, features, or the device is, or at any time was inconsistent with the normal inbound or outbound usage patterns for the type of service or plan that you have purchased.
  3. If we determine that you have tampered with your device. In this instance we also reserve the right to charge you the full purchase price of any device provided to you for use with the service under a "special offer" scenario.
  4. Our action or inaction under this section does not constitute any review or approval of your action, use or content.
